Which NSW food business must appoint a Food Safety Supervisor (FSS) for its premises?
NSW requires an FSS where the food a business prepares and serves is ready-to-eat, potentially hazardous and not sold in the supplier's original package. The other three businesses are on the Food Authority's exempt list because they do not handle unpackaged, potentially hazardous, ready-to-eat food.
A NSW food business holds a licence issued by the NSW Food Authority. What is its Food Safety Supervisor position?
Licensed businesses are exempt from the NSW FSS requirement. The Food Authority explains that they must meet Standard 3.2.1 Food Safety Programs, which match or exceed the requirements of Standard 3.2.2A. No head-count threshold applies to the exemption.
A NSW owner runs two cafés across town and holds a current FSS certificate. For how many premises may that person hold the FSS position at the same time?
Section 106B of the Food Act 2003 (NSW) says an FSS must not hold the FSS position for any other premises or for a mobile catering business. The Food Authority guideline repeats that a business with several premises must nominate a different FSS for each one.
From 8 December 2024, which of these NSW businesses also had to have an FSS?
The Food Authority guideline lists school canteens among the sectors that became subject to the FSS requirement from 8 December 2024, together with children's services, correctional centres, delicatessens, greengrocers, supermarkets, certain coffee vendors and boarding schools. The other three are exempt.
Who may a NSW food business owner nominate to be the business's FSS?
The FSS is nominated by the owner and may be the owner, a manager or an employee, provided the person meets the criteria in the Food Act: a current certificate, no other premises, and authority to supervise food handling. The role is not limited to owners or cooks.
